Background Information:

On 16 January 2008 the City of Austin completed negotiations to purchase 98 acres near the southwest corner of RR620 and RM2222 for WTP4. On this map the City now owns the two rectangular tracts outlined in bold and the irregular inland tract behind it.

In late August an application was filed by attorney John Joseph requesting that this property be zoned as a PUD (Planned Unit Development). The application was woefully incomplete and the applicant did not address Staff's comments, but the applicant proceeded to demand that the case be scheduled for hearings by the ZAP and City Council. At the 4 December 2007 ZAP meeting the Commission approved a request from 2222CONA for postponement of the hearing, and Commissioner Hammond got the applicant to agree to take the environmental variances that would be required for the project before the Environmental Board for a recommendation. The case was scheduled to be heard by the Environmental Board this evening. Today the applicant submitted this letter withdrawing the application.

Let's hope the taxpayers of Austin did not pay "PUD price" for this property as it did not meet the requirements for a PUD!
