Site Plan expiration extended to XXXXX.

Mitigation of encroachment into BCP property is still pending. The developer cleared about an acre of public preserve land, encroached on the preserve with foundations for two garden homes, and left debris on the preserve land when the development project was abandoned. The City of Austin legal department sent a draft mitigation agreement to the developer in September 2006, and it still had not been executed as-of March 2007. In late May 2007 the City filed a lawsuit against the developers, Eddie Jones and Sergio Lozano, for significant habitat damage on the City's Ivanhoe Preserve.
